A protective order is a court order signed by a judge that prohibits various forms of contact between individuals who are family members, household members, or individuals in current dating or former dating relationships. Traditionally, protect orders were created to protect a domestic violence victim from their abusive intimate partner. In the past, the abused victim would apply for a protective order in order protect themselves as they moved out or away from their abusive partner. However, today, the law allows for various form of protective orders for various reasons and for various durations.
In many instances, protective orders are a vital tool for abused victims. However, as the scope of the protective order has grown, some individuals use protective orders in manipulative ways. Over the years, I have seen individuals obtain protective orders to get an upper hand in a divorce or child custody hearing. For example, in an attempt to get an upper hand in a child custody battle, a person may falsely allege domestic violence to obtain a protective order. Additionally, it is not uncommon for a person to falsely allege domestic violence and to seek a protective order to use a leverage against their intimate partner.
If a judge orders a protective order against, then you will face several possible consequences. You may be prohibited from going to your children’s school. The court will prohibit you from possessing or purchasing a gun. The court will suspend your concealed handgun license.
